The Platform is owned and operated by RETAILCANVAS Private Limited, a company registered under the (Indian) Companies Act, 2013, having its registered address at 501, 5th Floor, Mathias Plaza, Sousa Business Centre, 18th June Road, Panaji 403 001, Goa, India (hereinafter referred to as “RETAILCANVAS” or “we” or “us” or “our”). This Privacy Policy (“Policy”) shall be read with our Terms of Use <please provide link here> (“Terms”) and Community Guidelines (“Guidelines”) and all capitalized terms not defined here shall have the same meaning attributed to it in the Terms.

The privacy of the Users accessing Our Platform is important to us and we have therefore provided this Policy to familiarize you with the manner in which we collect, use and disclose Personal Data (as defined below). Please read this Policy carefully before using the Platform or any of its services. 4. HOW WE COLLECT PERSONAL DATA:

We use different methods to collect data from and about You including through:

4.1 Information you provide us: We collect your Personal Data which you provide to us directly. This may include your username, password, mobile number, e-mail address and other details you upload when registering with the Platform and communications between Users and us or interse Users.

4.2 Automated information: We may automatically track certain Information about you based upon your behavior, acts, subscriptions and preferences on our Platform. We may include certain technical Information with respect to your device. Other automatic information that we collect include account information, purchase or refund information, page-view and clicks information, or other information about your interactions with businesses with which we operate co-branded offerings, who assist us in our targeted marketing, or for which we provide technical, fulfilment, advertising, or other services, search results and links, including paid listings.

4.3 Information from third parties or publicly available sources: We may receive information about you from third parties, such as Google.

4.4 Consent based information: We also collate location information or specific information which is collected by us after you enable the necessary permissions to us through our Platform.

5. HOW WE USE YOUR PERSONAL DATA:

5.1 Your Personal Data is used:

a) to perform functions on our behalf like fulfilling orders, delivering packages, rendering services, sending postal mail and e-mail, removing repetitive information from Customer lists, providing marketing assistance, processing payments and providing customer service.

b) to facilitate and enhance your usage of the Platform and providing you with information about the Platform, including new announcements, features, or services, so that you need not re-enter all your information during your subsequent visits;

c) to improve our Platform, to fix technical problems, if any and for internal research;

6.2 We reveal only the last four digits of your credit/debit card numbers when confirming an order for products or services on the Platform. Do note however that transmitting the entire payment information is transferred to your card issuer during order processing. For this purpose, we encourage you to go through the privacy policy of our payment aggregator.

6.3 We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of your Personal Data (including sensitive personal data). We may occasionally request proof of identity before we disclose Personal Data to you.

7. RIGHT TO ACCESS, UPDATE AND DELETE YOUR PERSONAL DATA

If we learn of a security systems breach, we will inform you and the authorities of the occurrence of the breach in accordance with applicable law.

8.2 We use commercially reasonable safeguards to help keep the Personal Data collected through the Platform secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account on the Platform. However, we cannot ensure the security of any Personal Data you transmit on the Platform or guarantee that Personal Data on the Platform may not be accessed, disclosed, altered, or destroyed.

8.3 We display interest-based advertising using information you make available to us when you interact with our Platform, content, or Services. In providing interest-based ads, we follow applicable laws. We do not have access to or control over cookies or other features that advertisers and third-party sites may use, and the information practices of these advertisers and third party Platforms are not covered by Our Policy.

10. HOW LONG DO WE RETAIN PERSONAL DATA:

10.1 We may retain certain Personal Data, after your account is deactivated, for a reasonable time for backup, archival, audit and/or legal purposes.

10.2 We may as we feel appropriate either delete your Personal Data or de-identify it so that it is not attributed to you.

10.3 You may contact us for erasing your Personal Data or for restricting the processing of your Personal Data.

RetailCanvas COMMUNITY GUIDELINES

1. Introduction:

RETAILCANVAS support freedom of speech and the fundamental right for individuals to express themselves, and expect every User to do the same. We recognize that criticism can be a valuable tool for helping each other improve. However, it is important to remember that criticism should always focus on the Product, and not on the Seller who sells it. You may share your opinion with others in the Forum, but in a constructive way. Before uploading any User Generated Content in the Forum, always ask yourself whether you would appreciate receiving the same from others. If not, do not upload and/or distribute it.

You are welcome to share your opinions and comments with the rest of the Users of the Platform through the Forum, provided that your User Generated Content is not irrelevant or done in a harmful or threatening manner. User Generated Content you provide on our Platform shall be deemed to be non-confidential and we shall be free to use such information on unrestricted basis and as and when deemed appropriate by us. These Community Guidelines (“Guidelines”) are to be followed by Users when uploading or displaying User Generated Content on the Forum and are to be read with the Terms <link here> and Policy <link here>. All capitalized terms not defined here shall have the same meaning attributed to it in the Terms.

2. Guidelines to upload User Generated Content on RETAILCANVAS:

2.1 In addition to the User obligations and other obligations laid under the Terms and Policy you shall ensure that the User Generated Content you upload on our Platform should not, at any time:

a) Defame, abuse, harass, threaten or otherwise violate the legal rights of any third-parties;

b) Be inappropriate, profane, abusive, libelous defamatory, vulgar, infringing, obscene, indecent, harassing, threatening, or inflammatory or otherwise objectionable or contains any such objectionable language or encourages such use;

c) Contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Platform or cause any harm;

d) Create or transmit unwanted electronic communications such as “spam,” to other users or members of the Platform or otherwise interfere with other users’ or members’ enjoyment of the Platform.

e) Is capable of conducting surveys, contests, pyramid schemes or chain letters, without our consent;

f) Include any offensive comments that are connected to race, cultural ethnicity, religious beliefs, national origin, age, sexual orientation, gender identity, disability or physical handicap or defames, ridicules, mocks, disparages, threatens, harasses, intimidates or abuses anyone;

g) Promote violence, contains targeted insults and/or coordinated efforts against any particular user or group of users and mocking their opinions and/or indulges or promotes

name-calling or attack people based on whether you agree with them or indicate a personal vendetta against user or group(s) of users.

h) Exploit or promotes the exploitation of any person or entity, especially minors.

i) Result in reverse engineering, reverse compiling or otherwise deriving the underlying source code or structure or sequence of any Platform, solution or technology or sequence of individual passwords of subscriber sites (or pages contained therein).

j) Is uploaded or distributed in anticipation of and/or as a result of accepting or soliciting a kickback, monetary or otherwise.

2.2 You should ensure that you are authorized to upload and/or share the User Generated Content on the Forum. User Generated Content that involves replicas or derivative creations may violate another person’s IPR.

2.3 User Generated Content, which is contrary to law, has no place on our Platform. Any User Generated Content featuring, encouraging, or soliciting illegal activities is prohibited.

2.4 Impersonation is strictly prohibited. Your user profile is your identity on our Platform. You are welcome to use a screen name but please refrain from using inappropriate names, bios, or profile images.

2.5 Everyone has the right to privacy, no matter who they are. We request you to ensure that you do not share personal details including personal information of another person (or entity) or any information that may be used to track, contact or impersonate that individual (or entity), without their permission. This includes recordings of private conversations, photographs, phone numbers, and home or email addresses.

2.6 We aim for our Platform to be a spam-free place. We therefore encourage you to refrain from activities that include (but are not limited to) uploading and/or distributing:

i. large amounts of repetitive, unwanted messages or user reports

ii. unauthorized advertisements

iii. Contents that encourage phishing

iv. Contents with an intent to defraud others

v. Contents spreading malware or viruses

vi. Contents promoting misinformation, disinformation, and misinformation (such as feigning distress, posting misleading metadata, or intentional mis-categorization of content)

The Guidelines, as elaborated under this Section are generic in nature and are non-exhaustive. Your actions might fall into cases that are not specifically laid down under these Guidelines but they may still be considered a violation of these Guidelines, if deemed so by us at RETAILCANVAS.

3. Reporting and Action:

3.1 As a user of the Platform it is possible that you might come across User Generated Content that you disagree with or find distasteful from time to time. You can choose to report such User Generated Content that you believe violate these Guidelines or not in accordance with applicable law with us at customercare@theretailcanvas.com

3.2 If we determine that a particular User Generated Content is infringing and violates our Guidelines, Policy, or Terms of Use, whether reported by another user or discovered by us through any means, directly and/or indirectly, we reserve the right to delete or retain the User Generated Content at our discretion.

3.3 On non-response from the Infringing User and/or if we are unable to reach the Infringing User, we may implement either one or a combination of the following precautions (“Precautions”):

i. remove the User Generated Content believed to be infringed from the Platform permanently;

ii. Suspend the account of the Infringing User;

iii. Terminate the account of the Infringing User;

iv. Report the infringement to appropriate authorities.

3.4 If the Infringing User is not in agreement with such Precautions implemented against him, he can contact us and we shall try to resolve the matter.

3.5 In general, we do not restrict you from uploading or distributing any type of User Generated Content. However, what we strongly stand against is if the User Generated Content is distasteful, offensive, derogatory or harms any third-party. We understand that there is no definite method of adjudging if a particular User Generated Content specifically violates these Guidelines and to what extent will such violation be tolerated. Any User Generated Content may be viewed as a violation by one party while another party may think differently. We at RETAILCANVAS, therefore consider this as a matter of our prerogative and shall take the necessary safeguards as we deem fit, if we, in our sole discretion, find the User Generated Content to be in violation of our Terms, Policy and/or these Guidelines.

4. Disclaimer:

4.1. We do not control or endorse the content, messages or information found in your User Generated Content or in any external linked sites that may be linked to or from the Platform and, therefore, we specifically disclaim any responsibility with regard thereto.

4.2. The ideas, feedbacks and other material(s) and User Generated Content uploaded by you are yours alone. We do not endorse your views and provide no warranties with respect to its accuracy or correctness. We shall not be held liable for the contents of such ideas, feedback and other material(s) contained in the User Generated Content uploaded and/or distributed on our Platform.

5. Indemnity:

5.1. You agree that you are solely responsible to us and to any third party for any breach of your obligations under the Terms, Policy and these Guidelines and for the consequences of any such breach.

5.2. You shall always indemnify and keep us indemnified in case of any claims including but not limited to third party claims, claims related to infringement and breach of any of our policies with respect to the ideas, feedback, content and comments uploaded by you through our Platform.
